How Do I Cancel My Immigration Bond?

Each day, those who reside in the United States without legal documentation run the risk of being detained by the Immigration and Customs Enforcement (ICE) agency. An undocumented status may be detected by something as meager as a routine traffic stop which means that ICE detainments typically occur without warning. Because of this, many families and loved ones of illegal immigrants find themselves scrambling to come up with the funds needed to secure the release of the immigrant through a bond. Despite the fact that this can be a financial burden, the fact that an immigration bond refund is possible leads many to pay in full. In order to receive a refund, the bond must first be canceled. This requirement prompts many questions such as how do I cancel my immigration bond?
Before attempting to cancel an immigration bond, it is important to first determine whether or not the bond is eligible for a refund. An immigration bond refund can only be issued when the bond is paid in full directly to ICE. This is done by designating one individual as an immigration bond sponsor who will then schedule an appointment at a local ICE facility. The person who acts as the sponsor must be a U.S. citizen or legal permanent resident with an original social security card and a photo I.D. The sponsor will be the one who is able to obtain an immigration bond refund, if eligible. If this is the route that was taken to secure the release of your loved one, keep in mind that the immigrant must also cooperate fully with the terms of their bond to be eligible for a refund. If they fail to appear in court or otherwise breach their bond, a refund will not be issued. Likewise, their court case must be fully resolved within the court system for an immigration bond to be canceled; however, the outcome does not affect refund eligibility.
From there, immigration bond sponsors will receive a Notice of Bond Cancellation (or a Form I-391). This form will be mailed to the address on file with ICE so bond sponsors should be sure to keep a current address on file with the agency. If you have relocated or otherwise have not received a Notice of Bond Cancellation and believe that you should have, reach out to your local ICE facility to confirm refund eligibility. Once the form is received, it should be forwarded along with Form I-305 to the Debt Management Center to be processed. The immigration bond refund will be mailed, although it may take several months to receive a check.
Those who used a bail bond service or agent will likely not be eligible for a refund, per their contract with the service. Despite this, any collateral provided will not be collected unless the immigrant breaches their bail bond contract.
