US Immigration keeps WWII Vet from being with his Son

89-year-old World War II Royal Air Force veteran, John Oliver, is in losing a fight to spend his final days with his American citizen son in New Jersey. It seems his only option is to sneak across the border illegally, but Oliver does not want to break the law. Oliver and his son have gone about the process to get a green card the honest way, filing all of the tedious paperwork and paying the required fees.

Everything seemed to be going according to plan until Oliver was barred from re-entering the U.S. for the next 10 years because he overstayed a 90-day visa that was issued in 2011. Oliver’s wife was very sick and dying, and her doctors recommended the couple remain in the states under the care of their son. Oliver’s wife’s health was deteriorating rapidly and the doctors stated that she would not survive a trip back to England.

The family followed all of the immigration system’s requirements and filled out all of the necessary forms for a legal immigration status, and when Oliver over-stayed his visa due to his sick wife, they notified and stayed in contact with the immigration office about his status in the U.S. The family filed forms with the State Department, homeland Security, and its immigration enforcement arm – the USCIS. The applications were denied.

The humanitarian provision is intended for cases such as Oliver’s, and is intended for exceptional cases. No lawyer will take the case unless Oliver is on U.S. property, and many have suggested that Oliver enter the country illegally through an unenforced Canadian border, which Oliver refuses to do since it is breaking the law.
