New Law Proposed Might Change Immigration Bonds Forever
An immigration bond is a surety that can be thought of as a form of insurance. Friends, family, or loved ones can have a nationwide immigration bondsmen post an immigration bond, which grants freedom to the detainee until trial. Some are arguing that immigration bond costs can be difficult to pay because the judges are setting them far too high. Detainees who cannot afford to post bond are then forced to remain in custody.
The ACLU Immigrantโs Rights Project is fighting for immigration law reform and possibly a monetary settlement for a client. Attorneys are arguing that immigration bonds set by judges and Immigration and Customs Enforcement agents are unjust and do not take into account the financial situations of illegal immigrants.
The ACLU attorneys argue that outrageous immigration bonds set by the courts are in direct violation with the fifth and eighth amendments, which guarantee due process and equal protection.
Bonds set at high prices are also keeping more immigrants in detention centers, thus decreasing their efficiency. It is not uncommon for detainees to be in these centers for upwards of four years while they collect the necessary documentation and await trial.
Immigration law reform or adjustment is a slow process, but nationwide immigration attorneys attempt to set legal precedents with new cases all the time. There is still no word on the case between the ACLU and the U.S. Government on bond amounts, but bail bonds experts are anxiously awaiting for the outcome.
