Los Angeles Immigrants are Offered a Way Out of Detention

Immigration bond experts know that most undocumented immigrants that are detained in America’s vast detention system only stay for a short period of time (approximately 30 days) before they are deported. However, for illegal immigrants that fight to stay in the United States, detention can last for months and sometimes even years.

Some detained immigrants are eligible to be released through an immigration bond that can be paid for with a US Immigration bail bond, while others are deemed ineligible for immigration bond by U.S. Immigration and Customs Enforcement (ICE), and are held for even longer.

In a Los Angeles federal court there was an important victory for immigration detainees. The court ordered for hundreds of immigrants who have been locked up for six months or longer to be provided with hearings in Immigration Court to determine if they are eligible for release through a local immigration bond.

The ruling does not mandate immigration judges to authorize an immigration bond for detainees, but it does require the government to justify their continued detention by proving that they are dangerous or a flight risk.

The ruling is limited and only applies to immigration detainees in Los Angeles, and is a life altering decision for immigrants who are detained for minor crimes and those seeking asylum. Affording bonding hearings to non-violent illegal immigrants will free up unnecessary spending to detain such individuals; it will also free up space for ICE to focus on deporting more violent and dangerous criminals.
