When Is an Immigration Bail Bond Necessary?

Immigration bonds are necessary for those who are Green Card holders or undocumented individuals detained by the US Department of Immigration and Customs Enforcement (ICE), awaiting the result of a case. There are a few types of immigration bonds available. An immigration bail bondsmen will issue one of four types of bonds. 

Types of Immigration Bonds

These are also referred to as ICE Form I-352 and there are four immigration bond types:

  • (G1) Delivery Bond
    • The most common type of immigration bond. It is an immigration bond relying on the delivery of a suspect, and that deportation is followed through with.
  • (G2) Public Safety Bond
    • Designed for the reimbursement of any fees to the government if the alien accepts any form of public assistance.
  • (G3) Voluntary Departure Bond
    • Based on court order, this bond is issued to ensure proper return to his/her home country within the conditions set forth in the order.
  • (G4) Order of Supervisions Bond
    • This bond is an order used to warrant that all conditions of supervision are met and the individual surrenders for removal.

Immigration bonds are available only to those individuals who match the requirements. If the defendant is denied bail, he/she will not be able to get a bail bond. Immigration bonds involve three parties. The defendant, which is the individual who is responsible. The individual who oversees that all fulfillments will be carried out by the defendant. The third-party involved is the immigration bondsman, whom the debt is owed to.
