Laws in the United States are dynamic, always changing and progressing. Freedom and human rights are both the most important and fundamental ideals in the U.S. Individuals who are caught entering or residing in the United States illegally will be detained, and an immigrant detainee’s rights may differ from those of American citizens. If you or a loved one have been detained, call US Immigration Bonds and we will fight for your loved one’s same-day release.

US Immigration Bonds has created and stored resources for immigrant detainees listed by state.

The U.S. Constitution is often discussed in the political arena, and American citizens take their rights very seriously. Some organizations like the American Civil Liberties Union and the Human Rights Council fight for the rights of everyone in the United States, including those who may be in the United States illegally. An immigrant detainee’s rights differ from the rights of an American citizen. Only American citizens and residents in good standing are protected by the United States Constitution.

So, what rights do individuals have and what resources for immigrant detainees are available?

  • Detainees have the right to be released on immigration bond.
  • Detainees have the right to an immigration hearing. However, they do not have the right to an attorney paid for by the United States government. Human rights groups like the ACLU, as well as churches and charities, will often visit immigration detention centers to help detainees find legal representation or to assist them in navigating the immigration legal system. If you are looking for an immigration attorney, call US Immigration Bonds and we will refer you to a trusted and experienced attorney.
  • An immigrant detainee’s rights include voluntary departure. It is important to note that a voluntary departure will not bar legal reentry into the United States. However, if the individual goes to an immigration hearing and the judge issues a deportation order, they will never be allowed to enter the United States again.
  • Living conditions that meet international human rights standards do not have the right to make a grievance if standards are not met. (Read more about detention center grievances)
  • The right to free phone services, to allow for unhindered communication with family and legal counsel.

Like most legally complicated proceedings, there are grey areas in the realm of an immigrant detainee’s rights. That is why it is important to stay constantly up-to-date on news, information, and resources for immigrant detainees.

  • There is no minimum or maximum amount of time on detainment. An individual can be detained for months at a time; and because of the back logged immigration court system, most are keep in detention centers for months on end. That is why US Immigration Bonds urges detainees to call today. We have reunited thousands of families, usually within hours of the first call.
  • Though it is within their rights to make a grievance about living conditions in detention centers, these living standards are guidelines and do not have to be maintained meticulously by U.S detention centers.

US immigration bonds were absolutely the best they were super professional. When I was down and out when my husband was detained by immigration they were very caring , knowledgeable, and patient. I called them a thousand times and they were very empathic and helpful everytime I called. they reassures me that everything would be fine, and that they would help me my husband, and my children be reunited again. They did everything they could to get me a same day release. They exceeded my expectations. I would not recommend any company other than US immigration bonds. Jeremy Wolf and his agency have been a terrific resource for me as I delve into this foreign world of bonding a friend out of jail so he and his wife can work on his case on the "outside." Jeremy has been unfailingly polite and informative and his video regarding how to complete the necessary forms was a valuable tool too. The entire process was quick and relatively easy. I especially appreciated not having to deal with a jaded, impatient, figure--it-out-yourself kind of person when I was treading in really unfamiliar territory. My questions were always answered quickly and efficiently.I highly recommend this company in your time of need for quick, efficient and professional service with no attitude or delay.read more

Jeremy Wolf, is compassionate and understanding. He has been there and done it with his own family, and together with his wife they dedicate their time and energy into helping other families come together. I know this because my husband was taken by ICE and his bond was set much higher than I could have imagined, having in my hands at any given time. ... With Jeremy, his wife and the rest of the team we were able to piece together the required 80% and set up a affordable and convient payment plan. It was a grueling process, at times I felt like I was going to loose all my hair, as I ran around selling homemade tamales, and had various other fund raisers going on, along with my husband being detained, I lost my home, my dog and my daughter and I pushed forward with the help and support of Jeremy and his team, if It wasn't for there hours of help and dedication, to put a previous bond for my nephew into action to help my husband, we wouldn't have been able to have him home for the Holidays. ... To Jeremy, Veronica, and Amber, who I spoke with often, and the other parts of the team who I was unable to catch their names, I THANK YOU, FROM THE BOTTOM OF MY HEART!read more
