An immigration bond is required to secure the release of an individual being detained by Immigration and Customs Enforcement (ICE).\u00a0Technically, an immigration bond is a surety bond and is a three-party contract between the Department of Homeland Security (DHS), the detained alien, and the entity posting the bond.<\/p>\n\t\t\t\u00bfQui\u00e9nes est\u00e1n involucrados en un contrato de fianza de inmigraci\u00f3n (los jugadores)?<\/a>\n\t\t\t\t\t\t\tExpand<\/i><\/a>\n\t\t

Una agencia que realice transacciones de fianzas de inmigraci\u00f3n en nombre de una compa\u00f1\u00eda aseguradora debe poseer ya sea una licencia de seguro de l\u00edneas generales o una licencia de fianzas, seg\u00fan los requisitos de los acuerdos de licencia del estado.<\/p>\n

La compa\u00f1\u00eda aseguradora tiene cr\u00e9dito con el gobierno de los Estados Unidos y la fianza de inmigraci\u00f3n representa la promesa de pagar la cantidad de la fianza a DHS en el caso de que se produjera un incumplimiento. Por ello, no hay traspaso de fondos cuando se emite una fianza de inmigraci\u00f3n con garante.<\/p>\n

Com\u00fanmente, un miembro de la familia o amigo del detenido o tercero, contratar\u00e1 a la agencia de fianzas para disponer que se gestione la fianza de inmigraci\u00f3n. Ese tercero le pagar\u00e1 al fiador un porcentaje predeterminado de la fianza y tambi\u00e9n ofrecer\u00e1 algo en garant\u00eda para asegurar la fianza.<\/p>\n\t\t\t\u00bfCu\u00e1nto cuesta una fianza de inmigraci\u00f3n?<\/a>\n\t\t\t\t\t\t\tExpand<\/i><\/a>\n\t\t

El costo var\u00eda de una compa\u00f1\u00eda a la otra. Si le entrega el monto total de la fianza directamente a DHS obtendr\u00e1 un reembolso completo si el detenido cumple con todas las condiciones estipuladas en la fianza. Pero este proceso puede ser confuso y una p\u00e9rdida de tiempo.<\/p>\n

Si contrata a una compa\u00f1\u00eda de fianzas para que pague la fianza de inmigraci\u00f3n, se le exigir\u00e1 que pague la tasa que la compa\u00f1\u00eda aseguradora del fiador haya declarado con el Departamento de Seguros en su estado de origen.<\/p>\n

Si tiene el monto total de la fianza en efectivo, puede visitar a un funcionario de inmigraci\u00f3n que acepte fianzas y pagarla usted mismo. Pero recuerde, est\u00e1 tratando con Seguridad Nacional y navegar por el sistema burocr\u00e1tico de DHS puede resultar dif\u00edcil y llevarle bastante tiempo. Tambi\u00e9n tiene que tratar directamente con el Servicio de Inmigraci\u00f3n y Control de Aduanas y deber\u00e1 ubicar una oficina de inmigraci\u00f3n que acepte fianzas, comprar un tal\u00f3n bancario o realizar un giro por el monto total de la fianza, y estar preparado para esperar muchas horas a fin de pagar la fianza.<\/p>\n

Si el expediente del detenido no est\u00e1 disponible o est\u00e1n trasladando al detenido a otra locaci\u00f3n\u00a0 (lo cual sucede a menudo) tendr\u00e1 que regresar al d\u00eda siguiente, una p\u00e9rdida de su valioso tiempo.<\/p>\n

Incluso tras el pago de la fianza, su dinero se enviar\u00e1 a una oficina en Vermont, antes llamada el Centro Financiero de Burlington (BFC), que maneja y supervisa toda la gesti\u00f3n de deudas para ICE.<\/p>\n

Finalmente, cuando el caso del demandado haya concluido ya sea que el demandado haya sido deportado, se le permita quedarse en los Estados Unidos o se hubiera marchado del pa\u00eds de manera voluntaria y haya proporcionado pruebas leg\u00edtimas, la fianza se cancelar\u00e1 y se emitir\u00e1 un Formulario I-391 de ICE (Aviso de Fianza de Inmigraci\u00f3n Cancelada) para el obligado (persona o entidad que pague la fianza).<\/p>\n

Ahora bien, una vez que recibe el I-391, debe enviar el Formulario I-305 de ICE original junto con una copia del I-391 a BFC para obtener el reembolso.<\/p>\n

Si no tiene el I-305 original, deber\u00e1 presentar un\u00a0Formulario I-395 de ICE<\/a>\u00a0(Declaraci\u00f3n Jurada en lugar de Recibo Perdido de ICE de Estados Unidos para Garant\u00eda Aceptada como Aval) junto con una fotograf\u00eda de identificaci\u00f3n y tres firmas.\u00a0 Desafortunadamente, la oficina de ICE que acepta la fianza a menudo le proporciona una copia del I-305, por lo que resultar\u00e1 imposible evitar el I-395).<\/p>\n

Y recuerde que las causas de remoci\u00f3n de inmigraci\u00f3n suelen permanecer activas por tres a\u00f1os o m\u00e1s. Mucho puede suceder en ese per\u00edodo de tiempo y muchas personas se ven obligadas a contratar a un abogado costoso para obtener el reembolso de la fianza. Otra desventaja de pagarla directamente con el DHS es que este solo est\u00e1 obligado a enviar los I-340 (Aviso de Comparecencia) a la direcci\u00f3n que aparece en el contrato de fianza I-352 para el demandado y el obligado.<\/p>\n

Por lo que, si se muda y no se notifica a ICE, puede que no reciba las notificaciones de ICE y es pr\u00e1cticamente seguro que se pierda su dinero.<\/p>\n
